Der Angeklagte Dirckmann hat auf dem Wege von Münster nach Nienberge den Soldaten Nettelwilm aus Nienborg erschossen; bei ihm war der andere Angeklagte. Er wendet Notwehr ein, er sei von dem Erschossenen beleidigt und bedroht und sei zunächst nach Reidegelts Kotten an der Pfaffenstiege geflohen. Zunächst entsteht ein Zuständigkeitsstreit zwischen Rat und dem Gografen zur Meest. Der Rat behauptet seine Zuständigkeit und entlässt die Angeklagten nicht aus der Haft. Als Zeugen werden vernommen 1. Johan von Havernbeck, Barbierer in Horstmar, 30 J. alt; 2. Henrich Üding in Horstmar, 32 J. alt; 3. Katharina Albering, Magd des Schulten Kalthoff in Nienberge, 21 J. alt; 4. Katharina, Frau Henrich Wideman, 26 J. alt, 5. Johan Engelberting, Bäcker des Domkapitels, aus Nienberge gebürtig, 44 J. alt. Dr. med. Bernard Rottendorff und mehrere Barbierer erstatten Gutachten.
